§ 6. Regulations applicable to all districts.

  • 6-100 The following regulations shall apply to all zoning districts listed in section 3 and as hereinafter defined in this section:

    6-101 Use: No building or structure shall be erected, raised, moved, placed, extended, enlarged, converted, constructed, reconstructed, or structurally altered, except in conformity with the regulations prescribed nor designed to be used or occupied for any purposes other than permitted by these regulations in the district in which such building, structure or land is situated.

    6-102 Height: No building or structure shall be erected, raised, constructed, extended, enlarged, reconstructed, or structurally altered so as to extend the height limit established in section 7 for the district in which such building or structure is located.

    6-103 Area: No lot shall be reduced or diminished so that the yards or other open spaces shall be smaller than prescribed in section 7, nor shall the density of population be increased in any manner except in conformity with the area regulations herein established. No side yard areas for a building shall be included as a part of the required areas for any other building. No parking area, off-street parking space or loading space which exists at the time these regulations become effective or which subsequent thereto is provided for the purpose of complying with section 8 of this ordinance shall thereafter be relinquished or reduced in any manner below the requirements established in section 8. Every building hereafter erected shall be located on a lot as herein defined, and in no case shall there be more than one building or use on one except as herein provided.

    6-104 Required yards: The planning and zoning commission may recommend and the city council of the City of Grapevine, Texas, may require a minimum front yard, rear yard or side yard greater than that required as a minimum setback by the specific zoning district when the safety of the traveling public and the general health, welfare and morals of the community require greater setback depth.

    6-105 Additional screening or fencing:

    (a)

    The planning and zoning commission may recommend and the city council of the City of Grapevine, Texas, may require screening or fencing on any zoning change in addition to or in lieu of screening or fencing requirements set out specifically anywhere else in the City Code of Grapevine, Texas, when the nature and character of surrounding or adjacent property dictate a need to require such screening or fencing devices in order to protect such property and to further provide protection for the general health, welfare and morals of the community.

    (b)

    The planning and zoning commission's recommendations and the city council's requirements under this section shall contain the following:

    (1)

    Specific location of fence;

    (2)

    Height of fence;

    (3)

    Type of construction; [and]

    (4)

    Location of openings, if any.

    (c)

    All fences or screening devices required to be constructed under this section shall be completed prior to the issuance of any certificates of occupancy for any other building or structure on any of the property within the area of the zoning change which prompted said fence or screening requirement; unless the city council modifies this requirement either through the zoning case itself or through subsequent formal action.

    (d)

    All fences or screening devices required to be constructed under this section must be maintained by the owner and failure to maintain same will constitute a violation of this section.
